Terms of Use

The following terms and conditions are entered into by and between SARVA and You (hereinafter: “the Member”).

The member must read the Terms & Conditions carefully and sign-off in agreement with the same.

  1. NAME
    1. SARVA Yoga is a brand owned by Zorba Renaissance Pvt Ltd (herein and henceforth referred to as ZRPL), and therefore all the invoices and other official communication to our members will be done under Zorba Renaissance Pvt Ltd.
  2. SERVICES
    1. The membership entitles the usage of SARVA facilities and the equipment & services available therein.
    2. The membership gives access to the SARVA Yoga studio allotted to the members, except if specified otherwise.
  3. MEMBERSHIP
    1. Membership entitles the member to a specific number of yoga sessions based on the membership package purchased. These sessions must be consumed during the term of the Membership.
    2. By enrolling with us members agree to share their contact number and email id to receive communication from SARVA in the form of SMS, WhatsApp messages, Newsletters and Phone calls.
    3. The Yoga sessions can be availed only by the member paying the fees. Transfer of membership can be approved only for select cases (medical emergency/ accidents).
    4. Membership fee once paid cannot be cancelled or refunded.
    5. The expiry date of any membership is always the last day and last session of the membership period.
    6. Membership fees must be paid in advance. The membership commences when SARVA has received the membership fee from the member.
    7. Though all reasonable care will be taken by the Instructors, SARVA is not liable for any injuries/damages that might occur during the Yoga Session.
    8. Any workshops conducted by SARVA during the terms of the membership will be paid workshops and will be optional for the member.
  4. PREREQUISITES
    1. The member need not have any prior experience of yoga.
    2. There is no age limit to join the Yoga sessions.
    3. S/he must take the responsibility for their decision to join Yoga considering their previous health ailments/ chronic disorders etc., if any.
    4. However, the member must be responsible enough to attend the sessions regularly and to abide by the Terms & Conditions.
  5. SESSION DECORUM
    1. The number of sessions in a week is scheduled on the basis of the package purchased by the member.
    2. The maximum duration of each session will be 60 minutes.
    3. SARVA has the sole discretion of allocating instructor for the sessions. Personal preference for instructor(s) communicated or expressed by any member will not be considered at any point for change in allocation of instructor(s).
    4. The Member will strictly follow all instructions issued by the Instructor during the Yoga Session.
  6. USE OF FACILITIES
    1. The Yoga studio and related facilities will be used for training purposes only.
    2. SARVA does not take responsibility for loss or theft of any personal belongings of members.
  7. CODE OF CONDUCT

    The member must respect the behavioural and operating principles and follow them on all occasions. This includes, but is not limited to:

    1. Wearing appropriate and clean clothes & shoes.
    2. Bring a yoga mat for the session.
    3. Leaving props intact after usage.
    4. Behaving in a friendly and respectful manner towards the other members as well as the SARVA staff.
    5. Consumption of alcohol, tobacco or any other addictive materials is not allowed.
    6. Consumption of foods/ beverages inside the Yoga studio is not allowed.
    7. The instructor can be contacted only during the session. In case, communication is necessary beyond the session hours, members can send messages to the instructor, however, response to the messages will be at the discretion of the instructor.
    8. Inappropriate or abusive communication to the instructor in any form (verbal, SMS, mail or WhatsApp) will not be tolerated. Any such communication when brought to the notice of SARVA management, who then can decide upon termination of membership with immediate effect and the liability of further legal actions.
  8. STUDIO DECORUM
    1. Studios open at specified time-slot, except on Sundays, public holidays or Government declared holidays.
    2. Members need to attend the Yoga sessions at the specified time-slot.
    3. SARVA’s staff will communicate to members in case there is/are any changes in the schedule or cancellation of session due to unavoidable circumstances.
  9. ACCESS & SECURITY
    1. SARVA yoga studios maintain access control for the members.
    2. Members will be allowed to go inside the yoga studio using the biometrics facility at the premises.
    3. If the biometrics facility is not available at the premises, the members need to sign on attendance register.
    4. If required, a member may be asked to provide identity proof at the reception.
    5. No one else will be allowed to get inside the Yoga studio with the member or during the absence of a member, by using the membership details.
  10. TERMINATION OF MEMBERSHIP
    1. The membership can be terminated at SARVA management’s discretion, in case any violation of code of conduct occurs.
  11. FROZEN MEMBERSHIP
    1. It is possible to freeze the membership for:
      1. Medical reasons, upon presentation of a medical certificate, or
      2. Military service, upon presentation of the official call to duty.
    2. For pregnancy, the membership freezing period can be 9 months. However, the member must inform the studio personnel at appropriate time about start and end dates of this period.
    3. The membership can be put on hold for period approved by SARVA’s management, after which the membership is automatically reactivated.
    4. To know more, the member needs to approach the studio manager.
  12. TRANSFER
    1. A member may choose to request for a transfer to a studio at a different location. S/he might have to pay a membership transfer fee.
    2. To know more, the member needs to approach the studio manager.
  13. POSTING PHOTOGRAPHS ON SOCIAL MEDIA
    1. SARVA may decide to post member photographs that are taken inside the studio (e.g. group photos) on social media.
    2. However, if a member has any objection for posting his/ her photograph, s/he needs to inform SARVA representative at the studio. Necessary actions will be taken to remove the photograph.
  14. Mobile Application
      By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Zorba Renaissance Pvt. Ltd.

      Zorba Renaissance Pvt. Ltd is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

      The SARVA app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the SARVA app won’t work properly or at all.

      You should be aware that there are certain things that Zorba Renaissance Pvt. Ltd will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Zorba Renaissance Pvt. Ltd cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

      If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

      Along the same lines, Zorba Renaissance Pvt. Ltd cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Zorba Renaissance Pvt. Ltd cannot accept responsibility.

      With respect to Zorba Renaissance Pvt. Ltd’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Zorba Renaissance Pvt. Ltd accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

      At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Zorba Renaissance Pvt. Ltd does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

  15. AUTHORISATION
    1. All requests from members related to yoga sessions will be evaluated and decision on the requests will be taken by SARVA’s authorised personnel.
    2. Terms, Conditions, and Fees are subject to change at sole discretion of SARVA.
    3. All disputes are subject to Chennai jurisdiction only.

I have read and understood the Terms & Conditions mentioned above and I agree with the same.
